This document constitutes the agreement between Web Frenchies (“seller”) and the below-identified person _________________(“buyer”) for the purchase of a puppy.

There are several terms and conditions to this agreement. There are also several disclosures by the seller. Acknowledgement and agreement to the terms, conditions and disclosures constitutes consideration in addition to the purchase price.

This is what the seller and buyer acknowledges and agrees to:

1. The puppy appears to be in good health as far as appears to the eye. The puppy will have a health inspection by the seller’s veterinarian before possession by the buyer. A licensed veterinarian must see the puppy within 3 days of arrival in order for this guarantee to be valid. Vet bills and/or medications are not covered in the guarantee.

2. Changes in a puppy’s environment can cause the puppy to become sick with upper respiratory infection, and/or coccidiosis. Seller gives no assurances, nor makes any promise that the puppy will not become sick with a condition that is due to the change in the puppy’s environment.

3. Puppies all grow up differently. Seller cannot, and does not guarantee the physical appearance or emotional disposition of the puppy as it matures. Such things as size, color, and breeding ability, as well temperament cannot be assured, and no guarantee or warranty is given regarding the puppy’s physical and/or emotional characteristics.

4. Certain congenital problems, though not apparent today, may become evident in the puppy’s first year. If the puppy is diagnosed with hip dysplasia, a grade 3 - 6 heart murmur, juvenile cataracts and/or luxating patella – grade 3-4, the puppy will be replaced. To be replaced, however, the puppy must be returned to seller within one year of the purchase date along with the veterinarian records diagnosing the condition. Seller’s responsibility under this agreement is limited to replacement. Seller is not responsible for veterinarian costs of any kind including costs associated with the diagnosis of conditions set out in this paragraph.

5. There are certain disorders that may be caused by environmental factors, for example: allergies, thyroid dysfunction, demodectic mange, and other autoimmune disorders that are not covered by this guarantee.

6. All puppies require special attention. It is especially important that the puppy’s diet and water requirements be met. Buyer’s initials after this paragraph demonstrate acknowledgement that they have received and agreed to follow the dietary requirements contained in the feeding requirements attached hereto. _______.

7. Because of the variety and quality of dog foods available (and all canine illnesses are NOT covered by vaccinations) we require that all of our puppies be supplemented with “Nu Vet Plus Canine.” This nutritional supplement is only available through breeder recommendation. Order Nu Vet on line by clicking on the icon or call the order line at 1-800-474-7044. The breeder order code is; 64246. The puppy must be kept on the Nu Vet vitamin for the first year or the health guarantee is null and void.

8. If the puppy dies, or becomes gravely ill within the first 72 hours after purchase, buyer agrees to immediately take the puppy to a veterinarian. Buyer further agrees to immediately notify seller of such condition, and to provide seller with the name, address and phone number of the veterinarian. Buyer also agrees to provide the seller with a signed authorization for release of the puppy’s medical records. In such instance, the puppy may be replaced if warranted by the circumstances. The decision under this paragraph to replace the puppy is at the sole discretion of seller. Such decision will be made in good faith as warranted by the circumstances of the puppy’s death or illness. This provision does not apply to death or injury due to trauma.

9. Buyer expressly acknowledges that seller is not responsible, under any circumstances, for veterinarian fees or costs. Any responsibility of seller under this agreement is limited to replacement of the puppy.

10. Buyer agrees to provide the pup with routine preventative care such as but not limited to: *Annual physical exam by your vet, *follow vet guidelines on deworming, vaccinations, and heartworm prevention

11. Buyer hereby acknowledges by signing this document and tendering payment for the puppy, the transaction for purchase of the puppy is complete and no cash refund will be given and the puppy may not be returned.

12. In the event of any dispute or disagreement under this contract, the laws of Missouri will govern the resolution of the dispute and venue for resolution of any dispute will be Missouri.

13. The contract will be deemed executed when the last party signs the agreement.

14. To the extent that any provision of this contract may be invalid under any law of the state of the buyer, all remaining provisions remain binding

THIS DOCUMENT CONTAINS THE COMPLETE AGREEMENT BETWEEN BUYER AND SELLER FOR THE PURCHASE OF THE PUPPY. NO OTHER REPRESENTATIONS, EITHER EXPRESSLY OR IMPLICITLY HAS BEEN MADE.
